The Impeachment Trial of Vice President Sara Duterte: A Call for Transparency

In a significant turn of events, House prosecutor and Manila 3rd District Representative Joel Chua made a bold statement this past Saturday. He emphasized the need to open a sealed Bureau of Internal Revenue (BIR) box during the impeachment trial of Vice President Sara Duterte, set to begin on Monday, July 6. This box contains the income tax returns of both the Vice President and her husband, Manases Carpio, and its contents have remained a mystery since it was presented to the House Committee on Justice.

The legal tug-of-war surrounding the box is heating up. The defense team insists that it should remain sealed and only be opened during an executive session, away from the public eye. However, Chua vehemently disagrees. He argued passionately, “There is no need for it to be opened in an executive session since this is already an impeachment court.” His words echoed the sentiment for transparency that many citizens desire.

Chua went on to draw a compelling analogy. He compared the impeachment court to a regular courtroom where tax-related cases are handled. “For example, in a tax evasion case, if a court issues a subpoena ordering the BIR to produce income tax returns, that is allowed, isn’t it? In that sense, we can liken the impeachment court to a regular court, where such requests are permitted.” His rhetoric stressed the importance of due process and public accountability.

In March, the House Committee on Justice issued a subpoena for the Vice President’s tax records as part of its ongoing deliberations on the impeachment complaints. Yet, the contents of the sealed box have been deferred for public scrutiny until the case reaches the Senate for trial. BIR Commissioner Charlito Mendoza previously mentioned that these tax records can only be unsealed if the request is made “in aid of legislation,” and must occur in an executive session rather than a public hearing. Chua, however, challenged this interpretation.

“Under the National Internal Revenue Code, the provision referring to an executive session applies to hearings at the committee level. But this is no longer a committee hearing. This is an impeachment trial,” he clarified. His assertiveness hinted at a desperate need for accountability in leadership, resonating with many citizens who crave transparency.

During a pretrial conference, the prosecution panel took another step, officially asking the impeachment court to open the BIR box. They wanted to inventory and mark its contents as evidence. But Duterte’s camp stood firm against this request, raising concerns that it could violate due process. The House prosecutors countered, suggesting that the defense’s reluctance stemmed more from “fear” than any legal justification.

At the heart of the prosecution’s case are serious allegations outlined in Article II of the Articles of Impeachment. They accuse Duterte of culpable violation of the Constitution and betrayal of public trust, which includes:

– Amassing unexplained wealth that is disproportionately large compared to her legal income while in public office.
– Failing to fully and truthfully disclose all her and her spouse’s assets, liabilities, and net worth in Statements of Assets, Liabilities, and Net Worth (SALNs) for the years 2022, 2023, and 2024.
– Willfully maintaining business interests during her tenure as Vice President from 2022 to 2025 without divesting as required.

As the impeachment trial looms, the call for transparency becomes louder. The sealed BIR box might hold the keys to answers, accountability, and clarity for the concerned citizens. In a time when trust in public officials is vital, the demand for the truth has never been more pressing, and the world will be watching closely.
