Actor Sandro Muhlach has made it clear that two independent contractors he accused of sexual assault are still facing a much more serious case.
This comes after the Pasay Metropolitan Trial Court dismissed the acts of lasciviousness charges he filed against Jojo Nones and Richard Cruz.
Why Were the Charges Dismissed?
The court ruled in favor of the motion to quash filed by Nones and Cruz, meaning the case was dropped. The decision explained that the acts of lasciviousness charges were already part of a separate and more serious case—rape through sexual assault—which Sandro had filed against them at the Pasay Regional Trial Court.
Since the rape case already includes the allegations, the court said keeping the acts of lasciviousness charges would be “overkill.”
Sandro Speaks Out
After the ruling, Sandro took to Instagram to clarify that the bigger case is still ongoing.
“The court removed the acts of lasciviousness charge because it’s already part of the sexual assault case, which is still ongoing. Meaning, mas matindi ang magiging kaso.”
Sandro also announced that he and his legal team will file a motion for reconsideration to bring back the acts of lasciviousness charges.
“But we will still file for reconsideration for acts of lasciviousness. Hindi sila makakalusot dito at ilalaban ko ‘to hanggang sa huli! I will make sure na hindi na kayo makakaulit sa iba! #ENDRAPE.”
Defense Team Reacts
Meanwhile, the lawyers of Nones and Cruz welcomed the court’s decision.
Atty. Maggie Abraham-Garduque, their legal counsel, shared her reaction on “Fast Talk with Boy Abunda.”
“We already received the resolution on that, and we are very happy that the court saw the legal infirmity that we have been raising since the onset of the case.”
The legal battle is far from over, as the rape through sexual assault case remains active in court.
