MANILA, Philippines — Senate President Chiz Escudero made it clear on Friday that the impeachment trial of Vice President Sara Duterte will continue—unless the Supreme Court (SC) decides to stop it by issuing a temporary restraining order (TRO).
In an interview with DZRH radio, Escudero explained that the Supreme Court has the power to interfere in impeachment cases, and it has done so before. He pointed out two major cases in the past:
- Former Chief Justice Hilario Davide Jr. – The SC issued a TRO that stopped the House of Representatives from proceeding with the impeachment.
- Former Chief Justice Renato Corona – The SC stepped in regarding issues involving his foreign currency accounts during the impeachment trial.
These past events show that the Supreme Court can get involved if necessary.
Vice President Duterte’s Legal Move
Since the House of Representatives has already started the process of removing her from office, Vice President Sara Duterte took legal action to fight back. On February 18, 2025, she filed a petition for certiorari and prohibition in the Supreme Court.
This petition is a formal request asking the Supreme Court to review whether the House of Representatives abused its power in handling her impeachment. If the SC finds any violations, it could cancel the impeachment proceedings.
What Happens If the Supreme Court Grants a TRO?
In addition to her petition, Duterte also asked the Supreme Court to issue a Temporary Restraining Order (TRO) or a Writ of Preliminary Injunction. If the Court approves her request, here’s what will happen:
- The impeachment trial will be paused until further notice.
- Duterte will stay in office while the legal battle is ongoing.
- The Senate won’t be able to continue with the impeachment trial.
The Senate’s Role in This Process
Senate President Escudero explained that the Senate is an important part of the impeachment process. However, in this case, the Senate is not the one making accusations against Duterte. Instead, it is simply the body that handles the trial based on the charges made by the House of Representatives.
